Court suspends Sh10m corruption case against Mike Sonko

Justice James Wakiaga, hearing a petition from attorney John Khaminwa on behalf of Sonko, said the ex-governor’s case will be heard on July 4th.

Sonko wants another judge appointed, Heard by Chief Magistrate Douglas Ogoti to hear the case now.

He has the Director of the Public Prosecutor’s Office (DPP), the Ethics and Anti-Corruption Commission (EACC), the Police Inspector General, the Attorney General and Mr. Ogoti as Defendant.

The court ordered all parties to the case to submit written comments by June 23.

Sonko’s Complaints

In the petition, Sonko claims that his right to a fair trial was violated when he was asked to appear in person, but legal representation is his constitutional and fundamental Law. He also noted that the doctors gave him complete rest after suffering various illnesses.

His former attorneys Cecil Miller and George Kithi dropped the case and then turned Dr. Khaminwa, Wilfred Nyamu, Assa Nyakundi and Evans Ondieki joined in to represent him.

Sonko was forced to appear in court after Dr. Khaminwa had stormed in protest of the alleged unfair circumstances of the trial.

The former governor accuses Mr. Ogoti of ruling on a motion from his former lawyers to withdraw from the case before filing motions.

Former governor says the new attorneys will need time to familiarize themselves with the case and then seek new instructions.

Mr Ogoti dismissed the bias issues raised by Sonko, saying that no evidence of personal bias had been presented to the court.

He also said there was no evidence that any other factor in his previous decisions in the case.

Besides the transplant case of Sh10 million is Sonko g two other corruption cases with Sh14 million and Sh354 million.

He was released on bail in all cases.
