Supreme Court strikes out Buhari, Malami’s suit against new Electoral Ac –

The Nigerian Supreme Court on Friday dismissed a Section 84(12) complaint filed by President Muhammad Buhari and Attorney General of the Federation (AGF) Abubakar Malami (SAN). of the electoral law.

A seven-member Supreme Court judge panel, headed by Musa Dattijo-Muhammad, unanimously dismissed the lawsuit alleging abuse of judicial process.

Judge Aokmaye Agim, who delivered the main verdict, noted that Buhari, having previously agreed to Section 84(12) of the Election Law 2022, could not turn back to approach the court to strike it down.

According to the ruling, “there is no provision in the Constitution that gives the President the power to challenge the constitutionality or desirability of any law after he has consented or withheld his consent,” it added that the President has approved the law.

He added that bringing Buhari’s motion to the National Assembly to scrap the provision was unconstitutional and held the lawsuit for a ploy by the President to get the court to uphold the violation.

“The President has no authority to request or compel the National Assembly to amend any part of the Act of the National Assembly that he helped create,” he added.
