The Department of Health’s ambitions to control the practice of doctors were defeated by the High Court in Pretoria after it ruled unconstitutional and invalidated the provisions of the National Health Act requiring the issuance of a ‘Certificate of Needs’ for healthcare facilities.

The ruling has “serious implications” for the implementation of the National Health Insurance (NHI) and the Department of Health will seek an overturn of the ruling and challenge the matter in the Constitutional Court, spokesman Foster Mohale said.
